Terms of Service

1. Acceptance of Terms

By accessing or using YourStream (the "Platform"), operated by YourStream ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you and YourStream. By creating an account, uploading content, viewing videos, or otherwise interacting with the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, which is incorporated herein by reference.

You must be at least 13 years of age to use the Platform. If you are between 13 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to request proof of age or parental consent at any time.

2. Description of Service

YourStream is a creator-friendly video streaming and sharing platform that enables users to upload, publish, view, share, and interact with video content. The Platform provides tools for content creators to build audiences, monetize their work, and engage with viewers in a fair and transparent ecosystem.

Our services include, but are not limited to:

  • Video hosting, encoding, and adaptive streaming delivery
  • Creator channels with customizable profiles and branding
  • Viewer interactions including comments, likes, bookmarks, and subscriptions
  • Creator analytics and audience engagement insights
  • Monetization through Pro subscriptions and supporter contributions
  • Content discovery through search, categories, and recommendations

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice. We will make reasonable efforts to notify users in advance of material changes that affect their use of the Platform.

3. User Accounts

To access certain features of the Platform, you must create an account. When creating an account, you agree to provide accurate, current, and complete information and to update such information as necessary to keep it accurate and complete.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately at support@yourstream.app if you suspect any unauthorized access to or use of your account. You are responsible for all activity that occurs under your account, whether or not authorized by you.

You may not create multiple accounts for deceptive purposes, transfer your account to another person without our written consent, or use another person's account without their permission. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or unauthorized purposes.

4. Content and Conduct

4.1 User-Generated Content

The Platform allows you to upload, submit, publish, and share video content and other materials ("User Content"). You retain ownership of the intellectual property rights in your User Content, subject to the license granted below.

By uploading User Content to the Platform, you grant YourStream a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content solely in connection with operating, promoting, and improving the Platform. This license persists for as long as your content remains on the Platform and terminates upon deletion, except where required for backup, archival, or legal compliance purposes.

4.2 Content Responsibilities

You represent and warrant that you own or have the necessary rights, licenses, and permissions to upload and distribute your User Content on the Platform, and that your User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.

4.3 Prohibited Content and Conduct

You agree not to upload, post, or transmit any content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Exploits or endangers minors in any way, including child sexual abuse material (CSAM)
  • Promotes terrorism, violence, or incitement against any individual or group
  • Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party
  • Contains malware, viruses, or any code designed to disrupt, damage, or limit the functionality of any software or hardware
  • Constitutes spam, unsolicited advertising, or deceptive promotional material
  • Impersonates any person or entity, or falsely represents your affiliation with a person or entity
  • Violates the privacy or publicity rights of any third party
  • Manipulates engagement metrics through artificial means such as bots, purchased views, or coordinated inauthentic behavior

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, and to take action against accounts that repeatedly or severely violate our content policies, including temporary suspension or permanent termination.

5. Creator Monetization

5.1 Pro Tiers

YourStream offers paid subscription tiers ("Pro") that provide creators with enhanced features including increased upload limits, higher video quality options, expanded storage, analytics, custom branding, and advanced monetization tools. Subscription pricing and feature details are available on our Pricing page.

Pro subscriptions are billed on a recurring monthly or annual basis. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. No refunds will be provided for partial billing periods unless required by applicable law.

5.2 Supporter Subscriptions

Viewers may support their favorite creators through recurring supporter subscriptions. These subscriptions allow viewers to financially support creators and may include access to exclusive content or features determined by the creator.

5.3 Revenue Sharing

YourStream retains a 15% platform fee on all creator earnings from supporter subscriptions and other monetization features. The remaining 85% is distributed to the creator. Payment processing fees charged by third-party payment providers are deducted separately and are not included in the platform fee.

Creator payouts are subject to minimum balance thresholds and applicable tax withholding requirements. We reserve the right to withhold or delay payouts if we reasonably suspect fraudulent activity, Terms violations, or pending disputes. Detailed payout schedules and requirements are available in your creator dashboard.

5.4 Changes to Monetization Terms

We may modify our fee structure, payout terms, or monetization features with at least 30 days' written notice to affected creators. Continued use of the Platform's monetization features after such notice constitutes acceptance of the revised terms.

6. Intellectual Property

The Platform and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of YourStream and its licensors. The Platform is protected by copyright, trademark, and other intellectual property laws of the United States and foreign jurisdictions.

The YourStream name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of YourStream. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Platform are the trademarks of their respective owners.

You may not copy, modify, distribute, sell, or lease any part of the Platform or its software, nor may you reverse engineer or attempt to extract the source code of that software, unless applicable law expressly permits such activity or you have our written consent.

7. DMCA and Copyright Policy

YourStream respects the intellectual property rights of others and expects its users to do the same. We comply with the Digital Millennium Copyright Act ("DMCA") and will respond to valid notices of alleged copyright infringement.

7.1 Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied and made accessible on the Platform in a way that constitutes copyright infringement, you may submit a DMCA takedown notice to our designated copyright agent. Your notice must include:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing and its location on the Platform, with sufficient detail for us to locate it (e.g., the URL)
  • Your contact information, including name, address, telephone number, and email address
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner

DMCA takedown notices should be sent to support@yourstream.app with the subject line "DMCA Takedown Notice."

7.2 Counter-Notification

If you believe that your User Content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our copyright agent. The counter-notification must include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification, your contact information, and consent to the jurisdiction of the federal court in your district.

7.3 Repeat Infringers

In accordance with the DMCA, we will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances. We may also, in our sole discretion, limit access to the Platform or terminate the accounts of users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

8. Termination

You may terminate your account at any time by accessing your account settings or by contacting us at support@yourstream.app. Upon termination, your right to use the Platform will immediately cease, and we will make reasonable efforts to delete your account data within 30 days, subject to legal retention requirements.

We may suspend or terminate your account and access to the Platform at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Grounds for termination include, but are not limited to:

  • Violation of these Terms or any applicable laws
  • Uploading prohibited content or engaging in prohibited conduct
  • Fraudulent or illegal activity
  • Extended periods of inactivity (accounts inactive for more than 24 months may be subject to deletion)
  • Failure to pay outstanding fees for paid features or subscriptions

All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. YOURSTREAM DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

We do not endorse, guarantee, or assume responsibility for any User Content posted on the Platform, or any product or service advertised or offered by a third party through the Platform. We are not responsible for any transactions between you and third-party providers.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YOURSTREAM, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to, use of, or inability to access or use the Platform
  • Any conduct or content of any third party on the Platform
  • Any User Content obtained from the Platform
  • Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9.3 Indemnification

You agree to defend, indemnify, and hold harmless YourStream and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Platform, your User Content, or your violation of these Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Platform shall first be submitted to good faith negotiation between the parties. If the dispute is not resolved within 30 days of written notice, either party may submit the dispute to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in the English language, and the arbitral award shall be final and binding.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending resolution of the dispute.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make material changes, we will provide notice through the Platform (such as a banner or notification) or by sending an email to the address associated with your account at least 30 days before the changes take effect.

By continuing to access or use the Platform after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, you must stop using the Platform and may terminate your account as described in Section 8.

We encourage you to periodically review these Terms for any changes. The "Last updated" date at the top of this page indicates when these Terms were last revised.

12. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Platform, constitute the entire agreement between you and YourStream concerning the Platform.

Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Waiver. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment. You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms without restriction.
